- No probable cause for a traffic stop.
- Search without consent
You’re standing on the side of the road, blinded by flashing police lights, with a police officer requesting consent to search your vehicle. Do you mumble a response or clearly answer? Responding with some mumbo-jumbo, a question, or something other than consent is not consent to search. The police like to do whatever they wish, so they may proceed with a search illegally. - Exceeding the scope of consent
Your roommate can’t consent to a search of your private room. Consenting to a search of your house doesn’t mean the police can search your vehicle. - Illegal vehicle inventory
The police love to tow a vehicle after an arrest because they get to inventory the car—a fancy term for “search the entire vehicle looking for contraband.” - Invalid search warrant
There is not enough room in this newsletter to begin explaining this one. Leave it to our team to find the defects in your search warrant. We won’t let you down.
