Hi, I’m Jay Cohen from Blass Law. And I want to talk about consent as an exception to the warrant rule.
What this means is that you gave the cops permission to search. Consent has to be valid, meaning it has to be given voluntarily and by a person with the authority to consent.
Voluntarily means that you weren’t coerced. No one had a gun to your head and you weren’t in handcuffs.
In order to have the authority to consent, you have to either be the resident or a person other than the resident only if the person has equal control and equal use of the property.
A landlord can’t consent to the police searching a tenant’s property. Look, if you or someone else was stupid enough to give the police permission to search, and now you’re charged with a crime, give us a call.
