Hi, I’m Jay Cohen from Blass Law and we’re here to talk about the offense of prostitution in Texas.
It’s important to realize this offense doesn’t require performance. All it requires is knowingly offering or agreeing to exchange money for sexual conduct. We commonly see these cases with stings. Officers have an officer in plain clothes at a gas station on the side of the road.
Someone drives up, rolls down their window. They have a little conversation, and then sexual conduct comes up. An officer gives out a fee, $20, $5, and if that person agrees, that’s the offense. It doesn’t matter what happens after that agreement.
The person could be like, “Ah I’m just kidding.” Or they could drive away like, “What a horrible mistake.” That doesn’t matter.
So, if you find yourself in that situation, look around. If it looks too good to be true, it’ll probably land you in jail.
