Hi, I’m Jay Cohen from Blass Law, and we’re here to talk about vape pens with THC. Previously, we talked about how any amount of THC oil is a felony in Texas.
No one wants to be charged with a felony. Some things that you need to remember if you are approached by the police with a vape pen is don’t admit to anything, don’t lie, and exercise your rights.
What are those rights? You have the right to remain silent, you have the right to have a lawyer present, you have the right to not incriminate yourself. We recently had a defendant who was approached by police with a vape pen.
-Asked, “What is it?”
-“Well, it’s a vape pen.”
-“Is it THC?”
-“Yeah, it’s THC.”
-“Where’d you get it?”
Said exactly where she got it.
What did that person do wrong? Well, they admitted, they didn’t exercise their rights. Lies weren’t really an issue there, not that they could prove. That’s the wrong thing to do.
Another example. Officers approached the defendant. They say, “Is that a vape pen?” He said, “Call my lawyer.”
They said, “What do you mean, call your lawyer? You don’t have a right to a lawyer right now.”
Said, “I’m not saying anything. Call my lawyer.”
Well, you know what? That was the right thing to do. Because that person didn’t admit to anything, didn’t have to lie, and exercised their rights.
So if you get caught with a vape pen, exercise your rights, tell them to call your lawyer, and then call Blass Law.
